Introduction

Welcome to TinyGoods! These Terms of Use ("Terms") govern your access to and use of the TinyGoods mobile application ("App"), developed and operated by Leonardo Bilhalva ("we," "us," or "our").

By downloading, installing, or using TinyGoods, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

1. Acceptance of Terms

1.1 Binding Agreement

By using TinyGoods, you acknowledge that you have read, understood, and agree to be bound by:

• These Terms of Use
• Our Privacy Policy
• Apple's App Store Terms of Service and Standard EULA

1.2 Age Requirement

TinyGoods is rated 4+ on the App Store and is intended for a general audience. You must be at least 13 years of age to use this App in jurisdictions where COPPA applies, or the equivalent minimum age in your jurisdiction (typically 13–16 under GDPR-K).

If you are below the age of legal majority, you may only use TinyGoods with the consent and supervision of a parent or legal guardian.

COPPA Compliance:
We do not knowingly collect personal information from children under 13. If we discover we have collected data from a child under 13 without parental consent, we will delete it immediately. Parents or guardians who believe their child has provided personal information should contact us at leobbbilhalva@gmail.com.

1.3 Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms within the App or on our website. Your continued use of TinyGoods after changes are posted constitutes your acceptance of the modified Terms.

We will notify you of material changes through:

• In-app notification
• Update to the "Last Updated" date above
• App Store update notes when applicable

2. License and Permitted Use

2.1 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use TinyGoods on your personal iOS device solely for your personal, non-commercial use, subject to these Terms.

2.2 Permitted Uses

You may use TinyGoods to:

• Paint and color the artwork pages provided in the App
• Save your paintings locally and review them in the gallery
• Customize palettes, adjust your work, and export your paintings to share or save
• Subscribe to TinyGoods Pro to remove advertisements and unlock premium content (when available)

2.3 Prohibited Uses

You may NOT:

• Use TinyGoods for any commercial purpose or for the benefit of any third party without our written consent
• Modify, adapt, translate, or create derivative works based on the App or its content
• Reverse engineer, decompile, disassemble, or attempt to discover the source code
• Remove, alter, or obscure any copyright, trademark, or proprietary notices
• Use the App in any way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any portion of the App or its servers
• Use automated systems (bots, scrapers, click-fraud) to interact with the App or its advertisements
• Resell, redistribute, or sublicense the App or any content derived from it
• Interfere with or disrupt the App's functionality, ad delivery, or servers
• Generate fraudulent ad impressions or clicks (this is a violation of AdMob policy and may result in account suspension)

3. Intellectual Property Rights

3.1 Ownership

All rights, title, and interest in and to TinyGoods, including all content, features, functionality, designs, graphics, text, software, source code, and artwork pages, are and will remain the exclusive property of Leonardo Bilhalva and its licensors.

This includes but is not limited to:

• App design and user interface
• Coloring page line art and templates
• Custom palettes provided as default content
• Animations, sound effects, and visual assets
• Branding and trademarks (the "TinyGoods" name and logo)

3.2 Your Paintings

You retain all rights to the paintings you create using TinyGoods. As detailed in our Privacy Policy:

• Your paintings remain on your device unless you choose to export or share them
• We do not claim ownership of your colored creations
• You may export and share your paintings at any time via the gallery

However, the underlying line art and templates remain our intellectual property — your color choices and creative expression are yours, but the original outline pages are licensed to you for personal use only.

4. Subscriptions and In-App Purchases

4.1 TinyGoods Pro

TinyGoods may offer optional auto-renewing subscriptions ("TinyGoods Pro") that unlock premium features such as ad-free use and exclusive content. The specific benefits, prices, and durations are displayed in the App at the time of purchase.

4.2 Billing and Auto-Renewal

• Subscriptions are charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
• The renewal price is charged to your account within 24 hours prior to the end of the current period
• You can manage subscriptions and turn off auto-renewal in your Apple ID account settings (Settings → [your name] → Subscriptions)

4.3 Free Trials and Promotional Offers

If a subscription includes a free trial, the unused portion of the trial period is forfeited when you purchase the subscription. Promotional offers may be available at our discretion and are subject to their specific terms.

4.4 Refunds

All purchases are processed by Apple. Refund requests are handled directly by Apple under its standard refund policy. We are not able to issue refunds directly. To request a refund, visit reportaproblem.apple.com.

4.5 Cancellation

You can cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period; you continue to have access to Pro features until then.

4.6 Price Changes

We may change subscription prices from time to time. Apple will notify you of any price increase in accordance with its policies. If you do not agree to the new price, you can cancel before the change takes effect.

5. Advertising

The free version of TinyGoods is supported by advertising. By using the free version of the App, you agree to view advertisements served by Google AdMob and its partners.

5.1 Ad-Supported Use

• Advertisements may appear when you open new coloring pages or revisit existing paintings
• You may be offered the option to watch a rewarded advertisement to access certain content
• Subscribing to TinyGoods Pro removes most or all advertisements (as described at the time of purchase)

5.2 Personalized vs. Non-Personalized Ads

Whether ads are personalized depends on your consent choices:

• App Tracking Transparency (ATT): iOS will ask whether you allow tracking. You can change this any time in iOS Settings → Privacy & Security → Tracking
• GDPR / EU regions: A Google-certified consent form (UMP) appears on first launch. You can change your choice via Settings → Privacy choices in the App

If you do not consent to personalized advertising, you will still see ads, but they will be non-personalized (based only on coarse signals like country and language).

5.3 Third-Party Ad Networks

Advertisements are delivered by Google AdMob and may include creatives from its partner ad networks. These third parties operate under their own privacy and content policies. We do not endorse and are not responsible for the content of advertisements.

6. User Content

If TinyGoods enables you to share or post your paintings (now or in the future), you are solely responsible for the content you create and share. You agree not to create or share content that:

• Infringes any intellectual property or other rights of any third party
• Is unlawful, harassing, abusive, defamatory, obscene, or otherwise objectionable
• Contains advertising, spam, or unsolicited promotional material
• Violates any applicable laws or regulations

We reserve the right (but have no obligation) to remove any user-shared content that we determine, in our sole discretion, violates these Terms.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we handle your information.

Key privacy highlights:

• Your paintings stay on your device unless you choose to share them
• We do not collect your name, email, or any account information
• We comply with LGPD (Brazil), GDPR (EU/UK/Switzerland), and US state privacy laws
• You can revoke ad tracking permissions at any time in iOS Settings

8. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY, RELIABILITY, OR COMPLETENESS OF CONTENT

8.1 No Guarantee

We do not warrant that:

• TinyGoods will meet your specific requirements or expectations
• The App will be uninterrupted, timely, secure, or error-free
• Advertisements will always be available, appropriate, or non-objectionable
• Premium features will be available without interruption
• Your paintings will never be lost due to device failure, OS updates, or app bugs (we recommend periodic exports as backup)

Any material downloaded or otherwise obtained through TinyGoods is accessed at your own discretion and risk.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEONARDO BILHALVA BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR USE
• LOSS OF PAINTINGS OR CREATIVE WORK
• EMOTIONAL DISTRESS OR MENTAL ANGUISH
• DAMAGES ARISING FROM ADVERTISING CONTENT DISPLAYED THROUGH THE APP

ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF TINYGOODS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.1 Cap on Liability

Our total liability for any claim arising out of or relating to these Terms or TinyGoods shall not exceed the amount you paid for the App and any subscriptions in the twelve (12) months preceding the claim, or one hundred U.S. dollars (US$ 100.00), whichever is greater.

9.2 Essential Purpose

The limitations in this Section 9 reflect the allocation of risk between the parties and will survive and apply even if any limited remedy specified in these Terms is found to have failed of its essential purpose.

10. Indemnification

You agree to indemnify, defend, and hold harmless Leonardo Bilhalva, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of TinyGoods
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your violation of any applicable laws or regulations
• Any fraudulent, automated, or abusive interaction with advertisements

11. Third-Party Services

11.1 Apple Services Integration

TinyGoods integrates with Apple's native iOS services, including:

• StoreKit / In-App Purchase: for processing subscriptions
• App Tracking Transparency: for advertising consent
• Photos / Files: for exporting your paintings (only if you explicitly use export features)

11.2 Other Third-Party Services

TinyGoods integrates with the following third-party services:

• Google AdMob & User Messaging Platform: ad delivery and consent management — policies.google.com/privacy
• RevenueCat: subscription management — revenuecat.com/privacy
• PostHog: product analytics — posthog.com/privacy

Each third party operates under its own terms and privacy policy. We are not responsible for the practices of these third parties beyond our direct integration with them as described in our Privacy Policy.

12. Termination

12.1 Your Right to Terminate

You may stop using TinyGoods at any time by:

• Deleting the App from your device
• Cancelling any active subscriptions through your Apple ID settings

12.2 Our Right to Terminate

We reserve the right to suspend or terminate your access to TinyGoods at any time, without notice, for:

• Violation of these Terms
• Fraudulent, abusive, or illegal activity (including click fraud or automated ad interaction)
• Any reason we deem necessary to protect our rights or the rights of others

12.3 Effect of Termination

Upon termination:

• Your right to use TinyGoods will immediately cease
• You must delete the App from all devices
• Sections 3, 8, 9, 10, 12.3, and 14 will survive termination
• Termination does not entitle you to a refund of any prepaid subscription fees, except where required by law

13. Updates and Modifications

13.1 App Updates

We may release updates to TinyGoods from time to time. These updates may include:

• New features, content, or coloring pages
• Bug fixes and performance improvements
• Changes to existing features or ad placements

You are not required to install updates, but we recommend keeping TinyGoods updated for the best experience and security.

13.2 Feature Changes

We reserve the right to modify, suspend, or discontinue any feature of TinyGoods at any time without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of features, except in the case of paid Pro features actively being purchased, where you may be entitled to a pro-rated refund through Apple if a feature is removed entirely.

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions.

14.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or TinyGoods shall be instituted exclusively in the courts of Brazil. You consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Leonardo Bilhalva regarding TinyGoods and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

15.4 Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

15.5 Language

These Terms are provided in English. In the event of any conflict between the English version and any translation, the English version shall prevail.

16. Apple-Specific Terms

16.1 Acknowledgment

You acknowledge that:

• These Terms are between you and Leonardo Bilhalva, not Apple
• Leonardo Bilhalva, not Apple, is solely responsible for TinyGoods and its content
• Apple has no obligation to provide maintenance or support for TinyGoods

16.2 Product Claims

In the event of any failure of TinyGoods to conform to any applicable warranty:

• You may notify Apple, and Apple will refund the purchase price (if applicable)
• To the maximum extent permitted by law, Apple will have no other warranty obligation
• Any other claims relating to TinyGoods are the sole responsibility of Leonardo Bilhalva

16.3 Third-Party Beneficiary

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

16.4 Standard EULA

Where these Terms are silent, Apple's Standard End User License Agreement applies to your use of TinyGoods downloaded from the App Store.
